SBSB Eastham Litigation Team Secures A Significant Win

The SBSB Eastham Litigation team secured yet another significant win in Houston federal court. This time a declaratory judgment action brought against firm clients Teichman Group, LLC and T&T Offshore, Inc. was dismissed by Southern District Chief Judge Lee H. Rosenthal.

Central to the dispute is the validity of an indemnity agreement surrounding a catastrophic event. The issue decided by Judge Rosenthal was more fundamental – did the court have jurisdiction over the dispute? Stated otherwise, was the indemnity agreement maritime in nature and subject to the court’s admiralty jurisdiction.

In a 30-page opinion ruling in favor of Teichman and T&T, Judge Rosenthal agreed with the defense team that the court lacked admiralty jurisdiction since the indemnity contract at issue was not maritime in nature.​

“Teichman, T&T, and their underwriters, are pleased the court took such a long and detailed review of the matter. We are very proud of the result,” said Susan Noe Wilson, head of the litigation group at SBSB Eastham.

The victory was a collaborative effort between lawyers from SBSB Eastham, Haynes and Boone and Hall Maines Lugrin, PC. The matter now continues in state district court.
